We have just entered new constitutional territory!
The claim of politicians and political lawyers, (with clear self-interest), that Parliament is sovereign has gone without serious public challenge for a very long time. With good reason. It was not an issue. Now it is. Parliament has ridden over democracy. Until this point, to say that the Parties in Parliament represent Electors was tolerably acceptable. Sometimes, even when far from the truth. Flexibility for government was understood.
Of course during General Elections, MPs to a man or woman, stoutly stated that the People were supreme and they were but humble servants.
The final passing of the Lisbon Treaty, giving the EU the extraordinary right in future to increase its range of powers without any further treaty or referendum, alters the relationship of Parliament and people. Who really controls is now THE ISSUE! There is only one answer in democracy, from its beginning. The People govern government! Because governments cannot be trusted. Now we know absolutely that Parliament and the House of Commons cannot be trusted with the crown jewels and treasury of democracy.
We need brand-new constitutional answers. Readers of this blog, (few at present, as I have done little to promote it), know how new thinking can be focused and be a self-generating force via a Magna Carta of democracy for this century. I have just sent the following comment, again to Mary Ellen Synon’s Daily Mail blog. I could have written to Daniel Hannan at his blog in The Daily Telegraph, as we seem to have certain views in common. But his comment column gets crowded. Also, his current issue is his return to the back-benches. This time Mary’s topic is right on the issue of the moment: the weak Conservative response to the EU, now the Lisbon Treaty has passed all hurdles. No comments had been posted when I sent mine. So I may have more chance of getting read. This time I included my web address! (rather basic, don’t you think?) The comment was as follows:

Who is sovereign in democracy? The People? Parliament that begs election and proves crooked? Or the EU we were never allowed to vote upon? Tony Blair said:
“We are not the masters. The People are the masters. We are the servants of the People… What the electorate gives, the electorate can take away.” (1997) Yes. Not only from Parties but from the EU! We are sovereign in democracy. Not the State. Not Parliament. Never the EU!
Politicians are employees. Not owners. By playing the “supremacy of Parliament” card concerning the EU, stealing our Supremacy in the face of continuous, majority protest, MPs deposed democracy in Parliament. By so doing, they disbarred themselves and their Parties from it!
I propose a Clear-Out Party, for Labour, Conservative and Liberal-Democrats voters. Wider than UKIP. In alliance with it. To shake Parliament to its very foundations. To break the smug main Parties. Plus a new branch of democracy, that magnifies and entrenches electoral control. Called Parallel or Super-Democracy. It outlaws the EU. It negates its institutions, directives and pivotal documents. See ddiff.com.
Article 3 states:
Democracy has two immutable principles:
Citizens control government: by oversight and approval, directly and indirectly. Goverments loyally ensure that control.
Without both, the State, Parliament, Government and European Union make themselves illegitimate and increase in democratic illegality. For, legality and sovereignty reside in the People, not in invented States or institutions.
Whoever and whatever devalues democracy in a democracy, by definition, acts illegally! The title deeds are ours. They stay ours. The House of Commons, acting as a tricky lawyer, has switched our over-all self-rule and prevented appeal.
The EU is democratically illegal. It has engineered the largest robbery of democratic power. It has stolen our electoral right of control. It can never gain legality. Thieves never own stolen property.
Parliament has its job. We have ours as employers of the State! To choose, cross-check and correct our system and Parties. As owners must. If we believe in the supremacy of these raiders. Or that erroneously-claimed by Parties and Parliament that have lost their honour, we collapse our intelligence like stars into a black hole.
How wrong can the Conservative Party get? They promise a Supremacy of Parliament Bill. In fact, we must have a Supremacy of the People over Parliament Act! Who holds more political sense? Sixty million on this island or 658 MPs now kneeling before the EU? If we come together, we can sort them out!
